Terms of Use

These Terms of Use ("Terms") govern your use of the Pluviophile mobile application (the "App"), developed and published by Sean Willmott ("we", "us", "our"). By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. The App

Pluviophile is an ambient sound application that lets you play and mix atmospheric soundscapes such as rain, thunder and wind. The App is provided for relaxation, focus and general enjoyment.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple-branded devices that you own or control, for your personal, non-commercial use, in accordance with these Terms and Apple's App Store Terms of Service. Where required, the minimum terms of Apple's standard Licensed Application End User License Agreement (EULA) also apply to your use of the App.

You may not copy, modify, distribute, sell, lease, reverse-engineer or extract the source code, audio recordings or other content of the App, except where such restriction is prohibited by law.

4. Future features

References to upcoming features, scenes or updates (in the App or its store listing) describe our current plans. While Pro includes future updates we release at no extra cost, we do not guarantee that any particular planned feature will be released, or by any particular date.

5. Intellectual property

The App, including its design, code, artwork, name and audio recordings, is owned by us or our licensors and is protected by copyright and other intellectual property laws. These Terms do not grant you any rights in the App other than the limited licence above. You may not use the App's audio outside of the App, including for redistribution, sampling or commercial use.

6. Acceptable use

You agree not to misuse the App, including attempting to gain unauthorised access to any part of it, interfering with its operation, or using it in any unlawful way.

7. Health and safety

The App is not a medical device and does not provide medical advice. Sound content is intended for general relaxation only. Please use a safe listening volume, and do not use the App in situations where reduced awareness of your surroundings could be dangerous (for example, while driving). If you have a sleep disorder or a hearing condition, consult a qualified professional.

8. Availability and changes

We may update, change or discontinue the App or any of its features at any time. We will make reasonable efforts to ensure purchased functionality remains available, but we cannot guarantee uninterrupted availability of the App.

9. Disclaimer of warranties

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the App will be error-free or uninterrupted.

10. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special or consequential damages arising out of or in connection with your use of the App. Our total liability for any claim relating to the App shall not exceed the amount you paid for the App in the twelve months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence.

Your statutory consumer rights are not affected by these Terms.

11. Changes to these Terms

We may update these Terms from time to time. The current version will always be available at this page, with the "last updated" date shown above. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of England and Wales, and any disputes are subject to the non-exclusive jurisdiction of the courts of England and Wales. If you are a consumer, you retain the benefit of any mandatory protections of the law of the country in which you live.
